Terms of Service

These Terms of Service ("Terms") govern your use of imgpile, operated by Click Here Digital Ltd, a company registered in England and Wales under company number 07093545, with registered office at 116 Station Road, Chinnor, England, OX39 4QG ("we", "us", "our"). By accessing or using imgpile you agree to be bound by these Terms. If you do not agree, do not use the service.

1. The service

imgpile is a free image and video hosting service. You may upload content anonymously or as a registered user. We reserve the right to change, suspend, or discontinue any part of the service at any time.

2. Eligibility

You must be at least 13 years old to use imgpile. If you are between 13 and 17, you represent that you have your parent or guardian's permission to use the service. If you upload adult (NSFW) content, you represent that you are at least 18.

3. Accounts

Registration is optional. If you register, you are responsible for keeping your credentials secure and for all activity on your account. Notify us at [email protected] immediately if you believe your account has been compromised.

You may delete your account at any time from your profile. When you delete your account, your content is soft-deleted and permanently removed from our storage and CDN within 30 minutes.

4. Your content

You retain ownership of everything you upload. By uploading content to imgpile you represent that you own it or have all necessary rights to upload and share it, and that doing so does not infringe anyone else's rights.

To operate the service, you grant us a worldwide, royalty-free, non-exclusive licence to store, host, cache, transcode, resize, generate thumbnails of, index, and serve your content to viewers you direct us to serve it to. This licence is solely for the purpose of running imgpile and ends when you delete the content. We do not use it to resell your content or sublicense it to third parties.

5. Acceptable use

Your use of imgpile is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Breaching the AUP is a breach of these Terms.

We use automated systems (including AI-based image and text classifiers) to detect content that may violate the AUP. We may remove content, hide it from public feeds, or suspend accounts based on these systems, with or without human review. You can appeal any removal by emailing [email protected].

6. Copyright and takedowns

We respect copyright. If you believe content on imgpile infringes your copyright, send a takedown notice to [email protected] including: (a) your contact details; (b) identification of the copyrighted work; (c) the URL(s) of the infringing content; (d) a statement that you have a good-faith belief the use is not authorised; (e) a statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorised to act on their behalf; and (f) your physical or electronic signature.

We will remove infringing content promptly once we receive a complete notice. The uploader may submit a counter-notice with equivalent elements. Repeat infringers have their accounts terminated.

7. Termination

We may suspend or terminate your access at any time, with or without notice, if we reasonably believe you have breached these Terms or the AUP. Sections 4 (your content licence), 8 (disclaimers), 9 (liability), 10 (indemnity), and 12 (governing law) survive termination.

8. Disclaimers

imgpile is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, about the service being uninterrupted, error-free, secure, or fit for any particular purpose. We do not guarantee that any specific content will remain available.

9. Limitation of liability

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under UK law.

Subject to the above: (a) we are not liable for indirect, consequential, or special losses, loss of profits, loss of goodwill, or loss of data; (b) our total liability to you arising from the service is limited to £100.

If you are a consumer in the UK, your statutory rights are not affected.

10. Indemnity

You agree to indemnify Click Here Digital Ltd against any claims, losses, damages, or expenses (including reasonable legal fees) arising from content you upload, your use of the service, or your breach of these Terms or the AUP.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the site. Continued use of imgpile after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute, except where UK consumer law gives you the right to bring a claim in the courts of your country of residence.
